Coup de théâtre !
Une évolution notoire est intervenue dans le dossier du recours en Appel de mon époux Bibou Nissack Olivier et de ses compagnons de lutte tous arbitrairement condamnés. Ceci intervient alors que la procédure devant conduire à l'ouverture d’un procès en appel était déjà bizarrement en train de s’enliser depuis quelques semaines ; et tandis que deux courriers restés jusqu’à date infructueux avaient été adressés au Tribunal Militaire de Yaoundé en vue de réveiller le processus menant à l'appel, alors que ce dernier avait été introduit en bonne et due forme depuis le 4 janvier 2022 par Bibou Nissack et ses compagnons condamnés injustement à des peines allant jusqu’à 07 ans de prison ferme.
Ce vendredi 04 février 2022, mon époux Bibou Nissack Olivier et les personnes condamnées par le Tribunal Militaire de Yaoundé avec lui, ont enfin et subitement reçu comme par magie, les documents suivants :
1- ORDONNANCE N°220088 CAB/PT/TMY PORTANT FIXATION DE LA CONSIGNATION datée du 21 janvier 2022 et présentée seulement aujourd’hui pour notification et signature à mon époux Bibou Nissack et ses compagnons de lutte.
2- PROCÈS-VERBAL DE NOTIFICATION D’UNE ORDONNANCE PORTANT FIXATION DE LA CONSIGNATION D'APPEL.
3- PROCÈS-VERBAL DE NOTIFICATION D’APPEL AUX PARTIES.
4- UN CERTIFICAT D’APPEL.
5- PROCÈS-VERBAL DE NOTIFICATION D’APPEL AU MINISTÈRE PUBLIC.
6- PROCÈS-VERBAL DE NOTIFICATION D’APPEL AU PRÉSIDENT DU TRIBUNAL (MILITAIRE).
7- PROCÈS-VERBAL DE DÉCLARATION ET DE CONFIRMATION D’APPEL.
8- PROCÈS-VERBAL DE RÉCEPTION D’UNE REQUÊTE D’APPEL.
Malgré le fait que de nombreuses irrégularités sont observables d’emblée, nous y reviendrons éventuellement ultérieurement, ce nouveau déroulement est enfin une avancée majeure vers la manifestation de la justice véritable durant le procès en Appel désormais à venir. Procès qui permettra sans aucun doute de faire annuler sans peine aux yeux du droit et de la loi, les décisions de condamnation illégales, honteuses et injustes, du Tribunal Militaire de Yaoundé.
La bataille judiciaire, en vue de l’évidente invalidation de la décision arbitraire de justice rendue par le Tribunal Militaire contre des civils non armés et pacifiques, est donc désormais en voie d’engagement.
Free Bibou Nissack Movement se réjouit de ce nouveau développement et y voit un fruit dont il peut sans gêne partager la saveur de la paternité avec tous ceux et celles qui travaillent inlassablement contre l’injustice dans cette affaire. Free Bibou Nissack Movement y voit aussi une source de motivation supplémentaire en vue de renforcer et intensifier l’action visant à faire triompher le droit et la justice pour mon époux Bibou Nissack, ses compagnons de lutte, et tous ceux condamnés arbitrairement comme eux du fait de leurs opinions.

A notorious development has occurred in the file of the appeal of my husband Bibou Nissack Olivier and his fellow fighters all arbitrarily convicted. This comes at a time when the procedure to lead to the opening of an appeal trial had already strangely bogged down for a few weeks; and while two letters that had so far remained unsuccessful had been sent to the Military Court of Yaoundé in order to reawaken the process leading to the appeal, while the latter had been properly introduced since January 4, 2022 by Bibou Nissack and his companions unjustly sentenced to sentences of up to 07 years in prison.
This Friday, February 04, 2022, my husband Bibou Nissack Olivier and the people convicted by the Military Court of Yaoundé with him, finally and suddenly magically received the following documents :
1- Order N ° 220088 CAB /PT /TMY FIXING THE CONSIGNMENT dated January 21, 2022 and presented only today for notification and signature to my husband Bibou Nissack and his fellow fighters.
2- MINUTES OF NOTIFICATION OF AN ORDER FIXING THE RECORD OF APPEAL.
3- NOTICE OF APPEAL MINUTES TO THE PARTIES.
4- A CERTIFICATE OF APPEAL.
5- MINUTES OF NOTIFICATION OF APPEAL TO THE PUBLIC PROSECUTOR'S OFFICE.
6- MINUTES OF NOTIFICATION OF APPEAL TO THE PRESIDENT OF THE COURT (MILITARY).
7- MINUTES OF DECLARATION AND CONFIRMATION OF APPEAL.
8- MINUTES OF RECEIPT OF A REQUEST FOR APPEAL.
Despite the fact that many irregularities are visible from the outset, we will come back to them eventually later, this new development is finally a major step towards the manifestation of true justice during the now upcoming appeal trial. A trial that will undoubtedly make it possible to have the illegal, shameful and unjust sentencing decisions of the Yaoundé Military Court annulled without difficulty in the eyes of law.
The legal battle, with a view to the obvious invalidation of the arbitrary judicial decision rendered by the Military Court against unarmed and peaceful civilians, is therefore now underway.
Free Bibou Nissack Movement is delighted with this new development and sees in it a fruit from which it can without embarrassment share the flavor of fatherhood with all those who tirelessly work against injustice in this matter. Free Bibou Nissack Movement also sees this as an additional source of motivation to strengthen and intensify the action to make law and justice triumph for my husband Bibou Nissack, his fellow comrades, and all those arbitrarily convicted like them because of their opinions.
