Affaire REDHAC : Me Alice Nkom condamnée avec sursis, Maximilienne Ngo Mbe totalement relaxée à Douala
Le Tribunal de première instance de Douala-Bonanjo a rendu son verdict ce lundi 21 septembre 2026 dans l’affaire opposant le Réseau des défenseurs des droits humains en Afrique centrale (REDHAC) à l’État du Cameroun. Maximilienne Ngo Mbe a été relaxée, tandis que Me Alice Nkom a été reconnue coupable de bris de scellés, mais relaxée du chef de rébellion. Elle écope d’un an d’emprisonnement avec sursis pendant cinq ans.
L’affaire REDHAC connaît son épilogue judiciaire. Après plusieurs mois de procédure, le Tribunal de première instance de Douala-Bonanjo a rendu sa décision ce lundi 21 septembre 2026 concernant Me Alice Nkom, présidente du comité d’organisation du Réseau des défenseurs des droits humains en Afrique centrale (REDHAC), et Maximilienne Ngo Mbe, directrice exécutive de l’organisation.
Le tribunal a déclaré Maximilienne Ngo Mbe non coupable et l’a relaxée, les faits qui lui étaient reprochés n’ayant pas été caractérisés.
La décision est différente pour Me Alice Nkom. L’avocate a été déclarée non coupable du chef de rébellion, mais reconnue coupable de bris de scellés administratifs.
Un an de prison avec sursis pour Me Alice Nkom
Pour les faits de bris de scellés, Me Alice Nkom a été condamnée à un an d’emprisonnement avec sursis pendant cinq ans, ainsi qu’à 500 000 FCFA d’amende.
Concrètement, cette peine ne signifie pas une incarcération immédiate. Le sursis suspend l’exécution de la peine d’emprisonnement pendant la période fixée par le tribunal. En cas de nouvelle condamnation dans les conditions prévues par la loi pendant cette période, les conséquences du sursis peuvent alors se poser.
Compte tenu de son âge, Me Alice Nkom n’a par ailleurs pas été soumise à la contrainte par corps.
Le tribunal l’a également condamnée aux dépens. Les éléments communiqués à l’issue de l’audience font état d’un montant de 66 600 FCFA à ce titre.
La rébellion écartée par le tribunal
L’un des enjeux de cette procédure portait sur les accusations de « rébellion en coaction » formulées contre les responsables du REDHAC.
Sur ce volet, la juridiction a écarté les poursuites à l’encontre de Me Alice Nkom et Maximilienne Ngo Mbe. Les deux responsables ont été déclarées non coupables de cette infraction.
Cette distinction est importante dans la lecture du verdict : Me Alice Nkom n’a pas été condamnée pour rébellion, mais uniquement pour le bris de scellés.
Maximilienne Ngo Mbe, pour sa part, bénéficie d’une relaxe sur l’ensemble des faits qui lui étaient reprochés.
Le REDHAC sort également de la procédure
Le tribunal a par ailleurs annulé les poursuites visant le REDHAC.
Cette décision intervient au terme d'une procédure qui avait commencé plusieurs mois auparavant, après l’apposition de scellés administratifs sur les bureaux de l’organisation à Douala.
Les scellés avaient été apposés sur instruction de l’administration, notamment du préfet du Wouri. Leur bris avait ensuite conduit à l’ouverture de la procédure judiciaire visant les responsables de l’organisation.
Une procédure ouverte après la fermeture des bureaux
L’affaire avait pris une dimension particulière en raison du statut du REDHAC, réseau engagé dans la défense et la promotion des droits humains en Afrique centrale.
La procédure judiciaire faisait suite à une séquence administrative au cours de laquelle les activités du réseau avaient été affectées par la mise sous scellés de ses locaux.
La justice devait notamment déterminer la responsabilité individuelle des personnes poursuivies dans le bris de ces scellés, ainsi que la matérialité des accusations de rébellion.
Le verdict rendu ce 21 septembre apporte désormais une réponse judiciaire à ces différents volets : pas de condamnation pour rébellion, relaxe de Maximilienne Ngo Mbe, condamnation de Me Alice Nkom pour bris de scellés et abandon des poursuites contre le REDHAC.
Une décision à plusieurs niveaux
Au-delà de la condamnation prononcée contre Me Alice Nkom, la décision du Tribunal de première instance de Douala-Bonanjo établit donc une nette distinction entre les différentes accusations formulées dans ce dossier.
L’avocate est condamnée pour le bris de scellés, mais le tribunal n’a pas retenu contre elle le chef de rébellion. Maximilienne Ngo Mbe est, elle, totalement relaxée. Quant au REDHAC, les poursuites engagées contre l’organisation sont annulées.
L’affaire entre ainsi dans une nouvelle phase, avec une décision judiciaire qui met fin à la procédure devant le Tribunal de première instance de Douala-Bonanjo, sous réserve des éventuelles suites procédurales prévues par la loi.

The proceedings had attracted attention because REDHAC is a network involved in the promotion and defense of human rights in Central Africa.
The judicial process sought to determine the individual responsibility of the people prosecuted for the breaking of the seals, as well as whether the allegations of rebellion were legally established.
The September 21 ruling now provides a judicial outcome on the different components of the case: no conviction for rebellion, full acquittal for Maximilienne Ngo Mbe, a conviction for Alice Nkom over the breaking of seals, and cancellation of the proceedings against REDHAC.
